1. Scope
These Terms govern the use of:
- Telekinesis APIs
- SDKs
- On-prem inference runtimes
- Developer Workbench
- Synthetic Data Studio
- Documentation, dashboards, and developer tools
These Terms apply to all Users: free tier, paid tier, integrators, OEM evaluators, enterprise trial users.
Commercial agreements (OEM Partner Agreements, Runtime License Contracts, Order Forms, SI Partner Agreements) override conflicting sections.
2. Account Registration
Users must provide:
- First name
- Last name
- Role (student, hobbyist, researcher, employee)
- Job description
- Company
Account data must be accurate. Passwords must be kept confidential. Minimum age: 16 (GDPR Art. 8). Commercial use requires age 18 or corporate authority.
3. Telekinesis Services
Telekinesis provides:
- Computer vision inference APIs (classification, detection, segmentation, pose, anomaly, point cloud, etc.)
- Developer SDKs (Python, C++, ROS2)
- On-prem enterprise inference runtimes
- Developer Workbench
- Synthetic Data Studio (if licensed)
Telekinesis may update or modify Services at any time.
4. Free Tier
Free access is provided “as-is”, without: • SLAs • Support guarantees • Uptime guarantees Support is provided on Discord community, with no guaranteed response time. Telekinesis may adjust limits or revoke access at any time.
5. Paid Plans
Paid services (API plans, developer seats, enterprise runtimes) are governed by:
- Order Forms
- Enterprise contracts
- OEM and SI partner agreements
Pricing is not part of these Terms and may change at any time.
6. Acceptable Use
Users may not:
- Reverse engineer APIs, SDKs, models, or weights
- Attempt to extract model internals
- Use output to train competitive models without written consent
- Use the Service for:
- Military applications
- Biometric identification
- High-risk surveillance
- Safety-critical control without redundancy
- Upload illegal content
- Share API keys or abuse rate limits
Telekinesis may suspend accounts for violations.
7. Intellectual Property
Telekinesis retains ownership of:
- Models
- Inference engines
- SDKs
- Documentation
- Runtime binaries
User retains ownership of:
- Input images
- Input videos
- Point clouds
- Output data
Telekinesis does not claim rights over user input or output.
Feedback and Usage Rights:
Customer grants Telekinesis a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to useany feedback, suggestions, enhancement requests, or recommendations provided by Customer relating to theServices. Telekinesis may also collect and use technical and usage metadata (excluding personal data orcontent) to operate, analyze, and improve its Services and models.
8. Data Processing
Telekinesis does:
- Not store input images, videos, point clouds
- Not persist inference data
- Not use input data for model training
- Not retain content after inference completes
Only minimal technical metadata is logged (timestamp, model used, request size, error logs).

9. Availability
Telekinesis makes reasonable efforts to ensure uptime but:
- Does not guarantee availability
- May perform maintenance
- Paid SLAs apply only under enterprise contracts
10. Liability (German BGB)
Free tier:
- Telekinesis liable only for intent or gross negligence (§ 521 BGB).
Paid tier:
- Liability limited to typical, foreseeable damages (§ 276 BGB).
- No liability for indirect or consequential damages.
- Nothing limits liability where prohibited by law (e.g., product liability).
Supplemental Warranty Disclaimer:
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose or non-infringement. For paid services, Telekinesis’ liability is limited to foreseeable, direct damages and shall not exceed thefees paid by Customer in the twelve (12) months preceding the claim. For free-tier use, Telekinesis is only liable for intent and gross negligence in accordance with § 521 BGB. Nothing in this clause limits liability where prohibited by applicable law (e.g., product liability or dataprotection violations).
11. Termination
User may terminate account anytime.
Telekinesis may terminate for breach, abuse, or non-payment. Perpetual runtime licenses remain valid unless materially breached.
12. Governing Law
German law applies.
Jurisdiction: Amtsgericht Darmstadt.
13. Amendments to Terms
Telekinesis reserves the right to modify or update these Terms (including the EULA, Privacy Policy, and DPA) from time to time. Customers will be notified of material changes via email or in-app notice at least 30 days in advance. Continued use of the Services after the effective date of the revised Terms constitutes acceptance. If the Customer objects to the changes, it may terminate the agreement before the changes take effect.
14. Export Control and Sanctions Compliance
Customer agrees to comply with all applicable export control, trade sanctions, and anti-boycott laws and regulations, including those of the European Union, the United States, and any other relevant jurisdictions. Customer shall not use or permit use of the Services in violation of such laws, including, without limitation, use in connection with restricted countries, end users, or prohibited applications. Telekinesis may suspend or terminate access to the Services if required to comply with legal obligations or regulatory investigations.
15. License Tiers
Access to the Services is provided under various licensing tiers, including free-tier, subscription-based access, or enterprise agreements. Specific terms (e.g., rate limits, support level, SLA) depend on the applicable plan selected or Order Form executed. These Terms apply to all tiers unless explicitly overridden by a separate written agreement.
16. Free Tier Data Collection and Usage
16.1 Input/Output Data for Free Tier
For Free Tier users only, Telekinesis may store, access, and use inference input data (including images, video frames, and point clouds) and output data generated by the Services for the following purposes:
- improving and training models
- quality assurance and testing
- abuse and fraud detection
- service analytics and optimization
Such data may be retained for up to [12 months], subject to technical or legal limits.
16.2 Paid and Enterprise Users
For Paid and Enterprise tier users, Telekinesis does not store, retain, or use any inference input or outputdata. Input is processed solely in memory and deleted immediately after inference completes. Telekinesis doesnot use Paid/Enterprise data for model training or analytics.
16.3 User Consent (Free Tier)
By using the Free Tier, the User provides explicit consent to the storage and use of input/output data asdescribed in this section. This consent is required for Free Tier access and complies with GDPR Art. 6(1)(a).
