1. Scope ​

This EULA covers:

  • API access
  • SDKs
  • Runtime binaries
  • Developer Workbench

Enterprise customers may receive additional license terms via contract.

2. License Grant ​

2.1 API License ​

Non-exclusive, non-transferable, revocable license for internal use.

2.2 SDK License ​

Used to develop internal integrations. Redistribution only with written approval.

2.3 Runtime License (Enterprise Only) ​

Perpetual, per robot/cell, machine-bound license. Governed by Order Form / Enterprise contract.

2.4 Developer Workbench ​

Per-seat license, non-transferable.

License Tiers Access to the Services is provided under various licensing tiers, including free-tier, subscription-based access, or enterprise agreements. Specific terms (e.g., rate limits, support level, SLA) depend on the applicable plan selected or Order Form executed. These Terms apply to all tiers unless explicitly overridden by a separate written agreement.

3. Restrictions ​

User may NOT:

  • Reverse engineer
  • Attempt to extract weights
  • Repackage the SDK into a competing product
  • Use for prohibited high-risk AI applications
  • Sell or share API access

4. Ownership ​

Telekinesis retains all rights. User retains ownership of input and output.

Feedback and Usage Rights

Customer grants Telekinesis a non-exclusive, worldwide, royalty‑free, perpetual, irrevocable license to use any feedback, suggestions, enhancement requests, or recommendations provided by Customer relating to the Services. Telekinesis may also collect and use technical and usage metadata (excluding personal data or content) to operate, analyze, and improve its Services and models.

5. Input/Output Data Storage and Use ​

5.1 Free Tier Data Collection and Usage ​

For Free Tier users only, Telekinesis may store, access, and use user input data (including images, video frames, and point clouds) and output data generated by the Services for the following purposes:

  • improving and training models
  • quality assurance and internal testing
  • abuse/fraud detection
  • analytics, evaluation, and optimization of the Services

By using the Free Tier, the User provides explicit consent to this processing under GDPR Art. 6(1)(a). Free Tier access is not available without this consent.

5.2 Paid and Enterprise Users (Strict No-Storage Policy) ​

For Paid or Enterprise tier users:

  • Telekinesis does not store user images
  • does not store videos
  • does not store point clouds
  • does not use input/output for training
  • processes inference only in memory
  • deletes all content immediately after inference

Only minimal technical metadata (non-content) is logged. This strict zero-retention policy overrides Section 5.1 for all non-Free-Tier users.

6. Support ​

  • Free tier → community Discord
  • Paid → email support
  • Enterprise → SLA if agreed by contract

7. Termination ​

Telekinesis may terminate for breach or misuse.

8. Warranty & Liability ​

Provided “as-is.”

The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose or non-infringement.

For paid services, Telekinesis’ liability is limited to foreseeable, direct damages and shall not exceed the fees paid by Customer in the twelve (12) months preceding the claim.

For free-tier use, Telekinesis is only liable for intent and gross negligence in accordance with § 521 BGB. Nothing in this clause limits liability where prohibited by applicable law (e.g., product liability or data protection violations).

9. Governing Law ​

German law applies. Jurisdiction: Darmstadt.

10. Amendments to Terms ​

Telekinesis reserves the right to modify or update these Terms (including the EULA, Privacy Policy, and DPA) from time to time. Customers will be notified of material changes via email or in‑app notice at least 30 days in advance. Continued use of the Services after the effective date of the revised Terms constitutes acceptance. If the Customer objects to the changes, it may terminate the agreement before the changes take effect.

11. Export Control and Sanctions Compliance ​

Customer agrees to comply with all applicable export control, trade sanctions, and anti‑boycott laws and regulations, including those of the European Union, the United States, and any other relevant jurisdictions. Customer shall not use or permit use of the Services in violation of such laws, including, without limitation, use in connection with restricted countries, end users, or prohibited applications. Telekinesis may suspend or terminate access to the Services if required to comply with legal obligations or regulatory investigations.
